153. How do I get my HOA to fix their new amendment to our Declaration?

We will assume your new amendment is for your planned community and has been recorded, review West Virginia Code §36B Uniform Common Interest Ownership Act, specifically:

§36B-2-117. Amendment of declaration.
(b) No action to challenge the validity of an amendment adopted by the association pursuant to this section may be brought more than one year [365 days] after the amendment is recorded.

(c) Every amendment to the declaration must be recorded in every county in which any portion of the common interest community is located and is effective only upon recordation.
